Essar, Loop pleas for interim stay of CBI summons dismissed by SC
TT Correspondent |  |  15 Feb 2012

Essar and Loop’s pleas seeking interim stay of summons by special CBI court was dismissed by the Supreme Court on Wednesday.

The apex court also issued notice to CBI on Essar and Loop's pleas challenging jurisdiction of special CBI court to hear the case against them in 2G scam.

“We would quash the proceedings if we come to conclusion that special CBI court has no jurisdiction to hear the case”, the court said

Essar and Loop group, chargesheeted along with its promoters, on February 9 had moved the apex court challenging the criminal proceeding against it before the special CBI court in the 2G case.

Essar had moved the apex court saying that they should not be investigated by the CBI as they have not been booked under the Prevention of Corruption Act. Ruias, the promoters of Essar Group and the Khaitans figured in the third chargesheet filed by the CBI on December 12. They face accusation of creating Loop for getting more spectrum.

According to the agency Essar group floated Loop Telecom flouting telecom guidelines. Essar holds sizeable shares in the existing operating company Vodafone.

Essar Group’s Ravi Ruia, son Anshuman Ruia and Ruia brothers’ sister Kiran Khaitan and her husband IP Khaitan were also named in the new chargesheet.

Meanwhile, the CBI has withdrawn from the apex court application seeking clarification over proceedings against the Essar Group.
