CBI today informed the Supreme Court that it will file a chargesheet against the former Communications and IT minister Dayanidhi Maran and T Ananda Krishnan even if the Malaysian authorities do not cooperate with the CBI.
Senior advocate K K Venugopal, appearing for the CBI, had placed progress report on this case in sealed covers before the bench comprising justices G S Singhvi and K S Radhakrishnan. Enforcement Directorate had also placed the report.
Venugopal told the bench that a CBI team had met with the Attorney General of Malaysia on March 21 and there was a detailed discussion based on the letters rogatory (LRs) sent to Kuala Lumpur.
He said mutual assistance treaty was signed with Malaysia after the LRs were sent and it was not clear whether they would go by the old or new regime.
However, he said Malaysian authorities are going through the materials on the issue to ascertain whether there was any element of criminality involved in the deal or not.
The bench wanted to know what would be the situation if the Malaysian authority declined assistance in the probe.
Venugopal said in such case “we have to make out a prima facie case based on our investigation here.”
He also the bench that CBI report contains its overseas probe in Mauritius, Island of Bermuda, United Kingdom and Northern Ireland.
The bench said it will take up the issue in July and till then CBI should try to complete the probe.
Maxis owner and Malaysian businessman T Ananda Krishnan are accused by CBI of forcing C Sivasankaran out of Aircel in collusion with Dayanidhi Maran, was involved in a similar controversy in Sri Lanka.
On October 9, CBI filed an FIR against former communications minister Dayanidhi Maran, his brother and promoter of SUN TV Group, Kalanithi Maran, T Ananda Krishnan, promoter of Maxis, Malaysia and Ralph Marshall, chairman of Maxis, Malaysia in relation to the Aircel-Maxis deal.
